2. Scope of Application
These Terms and Conditions apply to all purchases made through our website. By placing an order, you agree to these terms.
If any provision is deemed invalid, the remaining provisions remain in effect.
3. Nature of Products (Pre-Owned Luxury Goods)
We sell second-hand (pre-owned) luxury handbags, clothing, and accessories.
- Items are previously owned unless explicitly stated otherwise.
- Signs of wear may be present.
- Product descriptions, condition grades, and photographs reflect item condition as accurately as possible.
- Minor imperfections not affecting functionality may not always be individually listed.
By purchasing, you acknowledge the pre-owned nature of the goods.
4. Condition Grading Scale
All items are graded according to their condition. Visual guides and product photos form part of the assessment.
New (Unused):
- Never worn or used
- Original packaging and tags included (if applicable)
- Perfect, retail-like condition
Like New:
- Virtually no visible wear
- No stains, marks, or damage
- May have been used once or handled
- Structure, hardware, and interior are pristine
Excellent:
- Very light signs of use
- Minor handling marks or imperfections possible
- Fully functional and well-maintained
Very Good:
- Light signs of wear
- Minor scratches, creasing, or marks
- Fully functional
Good:
- Noticeable signs of use
- Scuffs, scratches, or discoloration present
- Fully functional
Fair:
- Significant wear
- Stains, structural wear, or defects possible
- Fully usable but heavily worn
5. Authenticity Guarantee & Brand Disclaimer
We guarantee the authenticity of all items sold.
- Items undergo internal authentication based on brand characteristics, materials, craftsmanship, and serial numbers (when applicable).
- Third-party authentication services may be used.
We are not affiliated with, endorsed by, or officially associated with any brand owners. All trademarks belong to their respective owners.
If an item is proven not authentic by a recognized independent authentication service, customers must notify us within 14 days of delivery with written verification.
6. Pricing
- All prices are in EUR (€).
- Prices include VAT where applicable.
- Shipping costs are displayed at checkout.
- Pricing errors may be corrected.
7. Orders & Payment
By placing an order you confirm:
- You are legally capable of entering a binding contract.
- All information provided is accurate.
We reserve the right to cancel orders due to stock issues, pricing errors, or suspected fraud.
Accepted payment methods: Credit Card, Debit Card, PayPal,
Orders are processed after payment is received.
8. Shipping & Delivery
We ship within the European Union.
- Orders are dispatched within 1-2 business days, unless explicitly stated otherwise
- Delivery times are estimates.
- Shipping costs are displayed at checkout.
- Customers outside the EU are responsible for customs duties.
High-value shipments may require a signature upon delivery.
9. Insurance & Risk During Shipping
- High-value items are shipped via insured delivery services.
- Insurance applies until confirmed delivery.
- Risk transfers to the customer upon delivery.
If a shipment is lost or damaged:
- Customers must notify us within 48 hours.
- Claims may require documentation and cooperation with the carrier.
We are not responsible for incorrect shipping information provided by the customer.
10. Right of Withdrawal (EU Consumer Right)
Consumers have the right to withdraw from a purchase within 14 days of receiving goods without giving a reason.
Conditions:
- Notify us within 14 days.
- Items must be returned unused and in original condition.
- Security tags must remain attached.
- Return shipping costs are the customer’s responsibility unless the item is defective.
Refunds are issued within 14 days after receiving returned goods.
We may reduce refunds if items show additional use.
Statutory consumer rights remain unaffected.
11. Returns for Defective or Incorrect Items
If an item is defective or not as described:
- Contact us within 48 hours of delivery.
- Provide photographs and documentation.
Where applicable, we provide replacement or full refund including shipping.
12. Final Sale Items
Items marked “Final Sale” or “Non-Returnable” cannot be returned or exchanged.
This does not affect statutory consumer rights.
13. Security Tag Policy
Certain items include security tags.
- Items must be returned with the tag intact.
- Removal or damage of the tag voids return eligibility.
- Items with removed or tampered tags will be refused.
14. Packaging & Unboxing Video Requirement (Claims)
To protect both customers and our business from fraud or shipping disputes, we require documentation for certain claims.
For claims related to:
· incorrect items received
· missing items
· shipping damage
· condition discrepancies
· suspected tampering during transit
customers must provide:
· a clear, continuous video recording of the package being opened, and
· visible proof of the shipping label and sealed packaging before opening.
Conditions:
· The video must begin before the package is opened.
· The package must remain fully visible in the recording.
· Claims submitted without this documentation may not be eligible for investigation or compensation.
Customers must report any issues within 48 hours of delivery.
This requirement does not limit mandatory consumer rights under applicable law but helps us process claims efficiently.
15. Tampering & Product Integrity Policy
Due to the high-value nature of our products, all items are inspected, documented, and recorded prior to shipment.
We reserve the right to refuse returns or claims where:
· there is evidence of wear inconsistent with the original condition listing
· components have been replaced, removed, or altered
· serial numbers, authenticity markers, or labels are missing or modified
· packaging, accessories, or documentation originally included are not returned
Any attempt to alter, substitute, or misrepresent a returned item may result in refusal of refund and further action where appropriate.
16. Intellectual Property
All website content, images, text, and logos are owned by Clutch & Croissant / Egle Trading and may not be used without permission.
17. Limitation of Liability
To the extent permitted by law, we are not liable for indirect or consequential damages arising from use of our products or website.
Nothing limits rights that cannot be excluded under applicable law.
18. Privacy & Data Protection
Personal data is processed according to our Privacy Policy and applicable data protection laws (GDPR).
19. Governing Law
These Terms are governed by the laws of The Netherlands.
20. Changes to Terms
We may update these Terms at any time. Changes take effect when published on the website.
